These Terms explain the rules for using Ownest, including account use, wallets, investing features, payouts, and user responsibilities.


1. Agreement to These Terms

These Terms & Conditions govern your use of the Ownest website, dashboards, APIs, wallets, content, and investment-related features. By creating an account or using the platform, you agree to be bound by these Terms and any related policies that are incorporated by reference.

If you do not agree with these Terms, you should not use the platform.

2. Eligibility

You are responsible for ensuring that you are legally allowed to use Ownest and to participate in the products offered on the platform. We may request identity, residency, financial, or compliance information before allowing access to certain features.

3. Account Responsibilities
  • You must provide accurate, complete, and current information when creating and maintaining your account.
  • You are responsible for all activity that occurs under your login credentials unless caused by our own verified internal error.
  • You must keep your password, verification methods, and account devices secure.
  • You must promptly notify Ownest if you suspect unauthorized access, fraud, or misuse of your account.
4. Platform Services

Ownest provides tools for fractional real estate investing, portfolio monitoring, wallet funding, earnings tracking, withdrawals, reinvestment features, secondary-market listings, governance participation, reports, and related investor services. Platform functionality may evolve over time, and not every feature will be available in every market, for every user, or for every property.

5. Wallets, Funding, and Withdrawals
  • Wallet balances shown on the platform are subject to transaction processing, approvals, platform rules, and operational review.
  • Deposits may be subject to verification, provider checks, or administrative review before becoming available.
  • Withdrawals are subject to payout rules, available balances, compliance review, and the payout methods enabled on the platform.
  • You are responsible for making sure that payout and withdrawal details are correct before submitting them.
6. Investments and Risk Disclosure

Investments made through Ownest involve risk. Property values can change. Payout schedules can vary. Projected returns are not guaranteed unless specifically stated as part of a binding product structure. Past performance, estimated yield, and model projections should not be interpreted as promises of future results.

You are responsible for reviewing the available property information, timelines, documentation, return structure, and any disclosed risks before deciding to invest.

7. Secondary Market Activity

Where enabled, Ownest may allow users to list eligible shares for sale to other users. Secondary-market activity depends on user demand, listing terms, pricing, wallet availability, and system rules. Ownest does not guarantee that a listed position will sell, that a buyer will always be available, or that a user will recover the full original investment amount.

8. Auto-Reinvest and Automation Features

If you enable auto-reinvest or similar automation tools, you authorize the platform to apply qualifying wallet balances according to the feature rules described on the platform. Automated actions are still subject to property availability, platform rules, operational safeguards, and system limitations.

9. Governance and Voting

Where governance tools are offered, voting rights and visibility may depend on your ownership position in a property. Unless explicitly stated otherwise, governance features may be advisory in nature and may not create binding obligations on platform operators, property managers, or sponsors.

10. Reports, Statements, and Tax Materials

Ownest may generate annual activity reports, yield summaries, or transaction records for convenience. Unless expressly stated otherwise, these reports are informational and do not constitute tax, legal, or accounting advice. You remain responsible for consulting qualified professionals regarding your own reporting obligations.

11. Fees, Charges, and Adjustments

Some features may involve fees, spreads, provider charges, or operational deductions, depending on how the platform is configured. Where applicable, fees should be shown within the platform workflow or account records. Ownest may update fee structures where allowed, provided such updates are reflected in the platform or associated policies.

12. Prohibited Conduct
  • Using the platform for fraud, money laundering, unauthorized transfers, or illegal activity.
  • Providing false information or attempting to bypass KYC, security, or operational controls.
  • Accessing the platform in a way that interferes with security, performance, or other users.
  • Reverse engineering, scraping, abusing APIs, or attempting to exploit vulnerabilities without authorization.
  • Misrepresenting ownership, listings, balances, or user identity.
13. Suspension and Termination

Ownest may suspend, restrict, or terminate access to all or part of the platform where reasonably necessary for security, fraud prevention, legal compliance, account review, risk management, or violation of these Terms. Where appropriate, access may be restored after successful review or remediation.

14. Intellectual Property

The Ownest brand, platform design, software, dashboards, reports, text, graphics, and other protected materials remain the property of Ownest or its licensors unless otherwise stated. Your use of the platform does not transfer ownership of those materials to you.

15. Service Availability

We aim to keep the platform available and reliable, but we do not guarantee uninterrupted access. Features may be updated, paused, removed, or modified for maintenance, compliance, operational, or security reasons.

16. Limitation of Responsibility

To the fullest extent permitted by applicable law, Ownest provides the platform on an operational basis and is not responsible for losses caused by market movement, user error, third-party outages, force majeure events, inaccurate user instructions, or reliance on non-binding projections. Nothing in this section is intended to exclude liability where the law does not allow it to be excluded.

17. Changes to These Terms

We may revise these Terms as the platform evolves. Updated versions may be posted on the website or made available in the app. Continued use of Ownest after updated Terms become effective will mean you accept the revised version.
